Club Given Until Thursday By FA To Meet ODT Demands


This from the FA:

On 27 November 2014, an Independent Regulatory Commission determined the charges against Hereford United and Mr Alan McCarthy in relation to failures to comply with Regulations 3.1.1 and 3.1.3 respectively of the Owners’ & Directors’ Test Regulations. 

The Club accepted the charge. Mr McCarthy failed to respond to his charge. 

The Independent Regulatory Commission found the charges proven and fined both the Club and Mr McCarthy £500. 

The Independent Regulatory Commission also ordered that the Club and Mr McCarthy fully and correctly comply with their obligations under the Owners’ and Directors’ Test Regulations by 4pm on Thursday 4 December 2014.

Failure to comply by that deadline shall result in the Club’s and Mr McCarthy’s automatic and immediate suspension from all football and football activities until such time as the Club and Mr McCarthy have either complied with the requirements of the Owners’ and Directors’ Test Regulations or Mr McCarthy has divested his shareholding in Hereford United such that he is no longer an Officer of the Club.

Meanwhile, a club statement about today's hearing reads:

Following this morning’s appearance at the High Courts of Justice to answer the ongoing winding up petition, the club is pleased to have been allowed a further 15 working days adjournment.

This morning’s events were further clarification of the agenda against the Football Club, indeed, the Court itself took account of, and commented on the appalling behaviour aimed at another prospective investor. 

The intention was always to take the football club forward in partnership with others, the last 10 days however have shown the lengths some are prepared to go to in order to achieve their ends, and good quality investment has been lost due to the campaigns mounted against these and other investors via social media, following the appalling campaign having already been waged upon Club Officials and their Wives and families. 

Therefore, as Chairman of Hereford United Football Club it requires me to take on full responsibility for the clearing of the inherited debt. An arrangement has been made with the Court for monies to be made available for those claims proven in Court, to be cleared. 

Upon clearing these debts, an opportunity will be given to HUST to come forward with any proposals they may have to move the club forward. This will depend upon them approaching the club and the ceasing of the current boycott. 

Hereford United's survival and ongoing prosperity is the sole reason for continuing this struggle. The rebuilding of the team to achieve a return to the Football League, plus the updating and refurbishing of the Stadium to enable Edgar Street to once again host high level football are central to the efforts to attain this. 

We will see this through to a satisfactory conclusion,
