Directors In Difficult Position After CVA Vote


After this afternoon's CVA meeting at Hereford United, John Line who attended the meeting as an advisor spoke to BN.

"I thought they were conducted very fairly by Marc Landsman, the nominated person.

"He gave people the chance to ask questions, those questions wre answered properly.

"The meeting was conducted cordially but then the creditors made their decision.

"And their decision to the necessary extent was to reject the CVA.

"So that goes away but it now leaves a very interesting situation as to what happens next.

"I think the existing directors will need to consider their position very carefully because they won't want to trade unlawfully or anything like that.

"That might mean they shut the club straight away or indeed they might play Saturday's game at Dorchester and then decide what to do.

"But they are placed in a very difficult decision.

"I sure the two directors there would feel aggrieved about the vote but they have to accept it.

"HMRC voted against it and once that was clear I think it was pretty obvious that the CVA proposal would get turned down."

Line was then asked what could happen at the High Court on September 1st when Hereford United are next due to appear.

"Potentially it could get adjourned again, it has already been adjourned a number of other times, but I think the judge would need to see a very good reason for adjourning it further.

"Unless a much better proposal comes forward, I can't see another CVA proposal getting accepted by creditors. If it's not significently better than the one that just been voted down then I can't think the judge would be very happy about that.

"Theorectically, if a new CVA proposal said that all creditors would be paid in full in six months the vote might be different.

"But no in the real world that's not going to happen.

"It's highly likely the club will be wound up on the first of September unless something unexpected happens."
