MP Jesse Norman has followed up HUST's query on the "fit and proper" test results with his own letter. It is understood that HUST have so far had no reply from their query last Friday.
This from Jesse Norman, sent today:
Dear Mr Landsman
I refer to current speculation that one or more of the current
Directors of Hereford United may have failed the Football
Association's Owners and Directors "fit and proper" Test.
Clearly this is a material fact with regard to the present petition
for a Company Voluntary Arrangement. Creditors and minority
shareholders alike are entitled to know if the present majority
shareholder and/or his nominees have been approved as owners and
directors by the FA; and this information may well bear on the value
of their shares or debt, and on their decision whether or not to take
part in the CVA. There are obvious legal implications, including
threat of suit, if this information is not disclosed prior to a
decision about the CVA.
It would also be a material fact if one or more of the directors who
had signed the CVA had failed the "fit and proper" test.
The Football Association have informed me that they have told you the
results of the ODT, and the names of which if any directors have
failed it. I would therefore be grateful if you would publish the
full facts on this issue immediately.
